How to Qualify for Georgia’s HB 112 Tax Refund

What You Need to Know

The State of Georgia has passed legislation (House Bill 112) that authorizes a one-time surplus tax refund for Georgia taxpayers. This refund is part of the state’s effort to return surplus funds from the 2023 fiscal year back to residents — and it could put up to $500 back in your pocket depending on your filing status and tax liability.But in order to receive it, you must meet certain filing requirements for both your 2023 and 2024 Georgia income tax returns — and the deadlines (especially with recent disaster relief) can be a bit tricky.

According to HB 112

“The term ‘qualified taxpayer’ means an individual taxpayer who filed an individual income tax return for both the 2023 and 2024 taxable years by the due date for filing the income tax return for the 2024 taxable year, including any extensions which have been granted.”

Important Update: You can still file 2023 by May 1, 2025, to qualify – if you have a 2023 extension.

However, if you have not yet filed your 2023 return and do not have a valid six month extension, you do not qualify for the refund.

Here’s a breakdown of what you need to know to make sure you qualify:

✅ Who Qualifies? You qualify if:

You were a Georgia resident who filed a 2023 Georgia income tax return “on time”, and

You file a 2024 Georgia return by May 1, 2025, without an extension; or by October 15, 2025, with an extension.

🗓️ 2023 Georgia Return

Original due date: April 15, 2024

If you filed a normal extension: You have until May 1, 2025

Bottom line:

🟢 To qualify for the refund, if you did not file your 2023 by April 15, 2024, you must have filed an extension prior to April 15, 2024, and your 2023 return must be filed by May 1, 2025, at the latest.

🗓️ 2024 Georgia Return

Original due date: April 15, 2025

Without extension filed by 5/1/2025;  May 1, 2025

With extension: You may file as late as October 15, 2025, if you file an extension by May 1, 2025.

💰 How Much Is the Refund?

If you qualify, the Georgia Department of Revenue will issue you a refund for the lower of:

Your 2023 Georgia income tax liability, or

The following based on your 2023 filing status:

$250 for single filers

$375 for heads of household

$500 for married couples filing jointly

Refunds will be automatically issued as direct deposits or paper checks, unless you have an outstanding balance owed to the state — in which case, the refund will be applied to that balance first.

⚠️ Important Reminder:

If you missed the April 15, 2024 deadline for your 2023 return and:did not file an extension, then your 2023 return is not considered “on time,” and you will not qualify for the refund.
